The short answer
Settlement day is when the legal and financial transfer of the property takes place.
This includes:
- The buyer paying the remaining balance of the purchase price
- The seller receiving their funds
- The property title being transferred into the buyer’s name
- Any mortgages being discharged or registered
All of this happens behind the scenes, usually without the buyer or seller needing to attend.
The longer answer
There is quite a bit going on in the background to make settlement happen smoothly.
Final checks are completed
Before settlement can proceed, all parties need to be ready.
This includes:
- The buyer’s lender providing funds
- The seller’s lender preparing discharge documents
- All identification and compliance checks being completed
- Any special conditions in the contract being satisfied
Your settlement agent coordinates all of this ahead of time so there are no surprises on the day.
Funds are transferred
On settlement day, funds are exchanged electronically through a secure platform such as PEXA.
This includes:
- The buyer’s loan funds
- The buyer’s remaining contribution
- Adjustments for rates, water, and other outgoings
These funds are distributed to the seller, their bank, and any other relevant parties.
The title is transferred
At the same time the funds are exchanged, the legal ownership of the property is transferred.
This means:
- The buyer becomes the new registered owner
- The seller’s mortgage is removed
- The buyer’s mortgage is registered, if applicable
This process is completed electronically and registered with Landgate.
Confirmation is issued
Once everything is complete, your settlement agent will confirm that settlement has occurred.
This is the moment everything becomes official.
For buyers, it means you now own the property.
For sellers, it means the sale is complete and funds are on their way.
When do you get the keys?
Settlement does not always mean immediate access to the property.
In most cases, keys are released by the real estate agent once settlement is confirmed. This often happens shortly after settlement on the same day.
However, the exact timing depends on what is outlined in your contract.
What could delay settlement?
While most settlements proceed as planned, delays can happen.
Common causes include:
- Late finance or lender issues
- Missing documents or identification
- Outstanding conditions not yet satisfied
- Last-minute complications with title or mortgages
